Maternity protection

Due to the Act on the New Regulation of Maternity Law of 23.05.2017, the Maternity Protection Act (Mutterschutzgesetz - MuSchG) will also apply to female students during their education at the university from January 1, 2018 under certain conditions. The most important regulations are listed below.

According to § 1 paragraph 2 no. 8, the law applies to female students, as far as the university specifies the place, time and course of the training event as obligatory or who complete an obligatory internship within the framework of the university Education

Pregnant women and mothers during their studies are entitled to a six-week period of protection before and at least eight weeks after birth from 1 January 2018.

It cannot be ruled out that there may be health risks for you or your pregnancy during your studies at some events. This could be the case in particular for scientific or engineering internships, workshop or laboratory activities. After your notification of your pregnancy, a so-called risk assessment must be prepared independently of the study programme, so that hazards can be identified and appropriate protective measures can be taken.

This is carried out by the responsible dean of the faculty.

Notification of pregnancy by the student

According to § 15, paragraph 1, a student should inform the university of her pregnancy and the date of delivery as soon as she knows that she is pregnant. The corresponding form "Notification according to § 27 paragraph 1 of the Maternity Protection Act" can be downloaded. In addition, a nursing student should inform the university immediately that she is nursing. There is no obligation to inform, but students can only invoke the protection provisions of the Maternity Protection Act if they have notified the university that they are pregnant or nursing.

The notification form must be accompanied by appropriate proof (copy of maternity certificate, certificate of study).

From there, other parties involved will be informed and consulted on your behalf. In particular, the responsible dean of the faculty will take the necessary protective measures within the scope of his responsibilities and, if necessary, also decide on applications on the audit side in coordination with the Audit Committee. In addition, the Maternity Protection Act imposes a notification obligation on the university to the responsible supervisory authority (the district government of Cologne).

Periods of protection before and after childbirth

During the term of protection (6 weeks before and 8 weeks after delivery), the university may only allow a student to participate in obligatory events as well as study and examination achievements if the student expressly requests this to the university; the student may revoke this declaration at any time with effect for the future.

Participation in voluntary events and the provision of study and examination services in voluntary events are at the student's discretion and are therefore possible without further explanation.

Duty of the university to notify

According to § 27 MuSchG, the university is obliged to make certain notifications to the supervisory authority, specifically to the district government of Cologne, regarding pregnant and nursing students.

Application for a leave of absence by the student

Students can apply for leave of absence due to pregnancy. An application to this effect must be submitted to the Registrar's Office. Students on leave of absence due to pregnancy are not entitled to study and/or take examinations.
